Takedown & IP Policy

Bidvers ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable international laws, we have implemented the following procedures for notifying us of alleged infringement.

1. PURPOSE

This policy allows intellectual property owners to report listings on www.bidvers.com that infringe upon their rights (e.g., copyright, trademark) or violate our prohibited items list.

2. NOTICE OF INFRINGEMENT (TAKEDOWN REQUEST)

If you believe that your work has been copied or used on our platform in a way that constitutes infringement, please provide our Designated Agent with a "Notice of Infringement" containing the following:

  • Identification of the protected work: A description of the copyrighted work or trademark you claim has been infringed.
  • Identification of the infringing material: The specific URL(s) or Auction ID(s) of the listing(s) you want removed.
  • Contact Information: Your name, address, telephone number, and email address.
  • Statement of Good Faith: A statement that you have a "good faith belief" that the use of the material is not authorized by the owner, its agent, or the law.
  • Statement of Accuracy: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner's behalf.
  • Signature: An electronic or physical signature of the person authorized to act on behalf of the owner.

3. OUR ACTIONS UPON RECEIVING A NOTICE

Upon receipt of a valid and complete Notice of Infringement, Bidvers will:

  • Expeditiously remove or disable access to the allegedly infringing material.
  • Notify the user (the "Seller" or "Uploader") that the material has been removed.
  • Maintain a record of the infringement to identify "repeat offenders."

4. COUNTER-NOTIFICATION PROCEDURE

If a user believes their listing was removed by mistake or misidentification, they may submit a "Counter-Notice" to our Designated Agent. This must include:

  • Identification of the material that was removed.
  • A statement under penalty of perjury that the user has a good faith belief the material was removed as a result of mistake.
  • The user’s contact information.
  • A statement consenting to the jurisdiction of the court for the judicial district in which the user is located (or Romania, if outside the US).
  • The user’s signature.

If a valid counter-notice is received, Bidvers may restore the listing within 10–14 business days unless the original complaining party notifies us that they have filed a court action against the user.

5. PROHIBITED ITEMS & CONTENT

In addition to intellectual property concerns, Bidvers reserves the right to take down any listing that involves:

  • Illegal goods or services.
  • Counterfeit items or unauthorized replicas.
  • Offensive, hateful, or discriminatory content.
  • Items that violate the safety or privacy of third parties.

6. REPEAT OFFENDER POLICY

In accordance with applicable law, Bidvers maintains a policy of terminating the accounts of users who are deemed to be "repeat offenders." We reserve the right to ban any user who receives more than [e.g., three] valid takedown notices within a 12-month period.

7. LIMITATION OF LIABILITY

As a neutral venue for auctions, Bidvers is not responsible for the content of listings posted by users. However, we are committed to acting as an intermediary to resolve disputes through this Takedown Policy.
